Mindy began her career with the Interstate Commission for Adult Offender Supervision’s National Office in 2004. As the Training Coordinator, Mindy administrates online trainings, updates training publications and provides support in onsite trainings through the Commission’s Technical and Training Assistance program. Mindy also assists in the Commission's annual compliance audits and serves as a project team member in the development and support of the Interstate Compact Offender Tracking System (ICOTS). The proposed revision establishes a standardized timeframe by requiring departure notifications to be transmitted no earlier than five (5) business days prior to the intended departure date. This ensures consistency across jurisdictions and enhances the effectiveness of interagency coordination. By explicitly mandating the inclusion of travel details, the revision improves tracking capabilities and accountability. Additionally, clarifying that this rule applies to individuals under all applicable ICAOS rules ensures comprehensive coverage and uniform compliance.  Removal of language in section (c) will help reduce confusion among ICOTS users, as withdrawing reporting instructions prematurely can result in unnecessary work and confusion during the transfer process.

In VA, we are working to devise a mechanism to have more information recorded when supervised individuals depart for a RS in the event they do not arrive so we can better track where they might be. In this section, "The departure notification shall include the method of travel and date by which the supervised individual is instructed to arrive.", would it be possible to also include "Accompanied by: _____" and "Itinerary (aka stops)"?

Commissioner Zavaras began his career in Criminal Justice as a Community Parole Officer (CPO) for the Colorado Department of Corrections, Division of Adult Parole in 2005. As a CPO, he became knowledgeable on supervising virtually every type of caseload available from interstate cases to gangs and sex offenders. Following subsequent promotions, he became the Division's first supervisor of the Housing & Stabilization Unit, focused on hard to serve parolees experiencing homelessness and/or high mental health needs. The new rule removed the reason why you're submitting them from subsection (a), Departure Notification.

The revised rule takes out the responsibility to send ‘on time’. Removed from the original rule, ‘At the time of departure’. Now it is just saying submit no earlier than 5 business days. The new language takes away the Sending State's obligation to submit when departing.

NY would not support this proposed change. The point of the notice of departure is to advise the receiving state that the individual has left the sending state. Allowing the submission of the notice up to 5 business days prior to an intended departure date does not accurately track the supervised individual’s movement/location and maybe problematic if the individual’s travel plans change, etc.

I don't think the NOD should be done prior to the SI's physical departure date. There are too many instances where the SI's plans change, and they don't depart as planned. The RS communicates the client has departed and this change may require the RS to determine the arrival date manually.

If the individual departs timely, then the 5 days earlier will not be problematic, but we as states can still submit the day of. Hopefully there is timely follow up in the event the person cannot depart as expected to avoid unnecessary FTA

Tracy Hudrlik is the Interstate Director for the MN Department of Corrections. In this role, she serves as the Commissioner for Interstate Compact on Adult Offender Supervision (ICAOS) and the Interstate Compact for Juvenile (ICJ) for Minnesota. I like that it limits how far in advance a NOD can be submitted. I agree that the rewrite should allow for withdrawal if departure does not occur. We do train to do it at the actual time of departure, but it makes more sense to do it slightly ahead of time rather than after the fact when departure occurs over holiday, weekend, etc.

Dori Littler has held her current position as the Deputy Compact Administrator (DCA) for Arizona Adult Probation since December 1999. Prior to this position, She was an adult probation officer with the Gila County Probation Department in Globe, Arizona. As DCA, she is responsible for training and oversight of the interstate compact program. She was appointed as Arizona’s Compact Commissioner in January 2005, currently serves on the Rules Committee, and is a national trainer for the Training Committee. For persons sentenced virtually, the SS should be required to submit the NOD on the same day the request for reporting instructions is submitted. Too often, the SS fails to submit the NOD even though the person is already in the RS. This language should be added under (a).

Chris Moore has served as Interstate Compact Administrator/Commissioner for the State of Georgia since 2012. Chris began his career in Community Supervision in 1989 as a Probation Officer. In 1998, he moved to Central Office as a Field Support Specialist and his program area was Sex Offender Supervision. In 2005 he was promoted to Center Administrator of a Day Reporting Center and in 2009 he was promoted to Chief Probation Officer. Chris received his BBA from Mercer University in 1989. He is also a Certified P.O.S.T Instructor and a Certified Alcohol and Drug Counselor.

Things can happen that change the acual time of departure regardless of rwhen the NOD is submitted. It would be great to have the ability to withdraw the NOD in the event the new departure date is more than 5 days from the time the NOD was submitted.

Fareeda Washington began her career with the Clay County Detention Center where she served as a Deputy Juvenile Officer. In 2008 she was hired by the Unified Government of Wyandotte County where she worked in the Community Corrections Department as an Intensive Supervision Officer. In 2017 she was promoted to an Intensive Supervision Supervisor. Fareeda accepted the role as Director of Interstate Compact Services for the state of Kansas in 2022.

KS agrees that there should be a consistent limitation as to how early NOD should be allowed to be transmitted however KS does suggest that the rewrite allow for a withdrawal of NOD as there are many instances where the individual does not depart when intended.
