Create new rule for reporting instruction qualifications and processes for sex offenders to improve accessibility to requirements.  The addition of requesting the conviction paperwork (judgment and sentencing) pertaining to the sex offense, if available, is helpful for states to better determine registration/requirements in the receiving state, especially in cases where the instant offense is not the registerable sex offense.  Including reference to virtual sentencings will acknowledge in the rule the practice that many states have and will support the interpretation of this rule issued in the Legal Implications of Remote Hearings in Relation to ICAOS Rules issued in 2021 and avoid unnecessary denials of reporting instructions in these situations.

In addition to the sex offense sentencing docs, could we add the sex offense narrative if not the current conviction, if available? That way we know what they actually did, not just what they pleaded and can supervise them appropriately to 4.101.

NY would agree with the proposed change to existing rule 3.101-3 and moving d, e, f & g to new rule.
NY would not support the proposed wording in the new rule – 3.XXX Reporting Instructions for Sex Offenders. While the wording in (b)(1) is our current wording in Rule 3.101-2, this language is vague and may lead to inappropriate denials of mandatory reporting instructions.

NY would suggest that the wording in wording in (b)(1) mirror the language proposed in 3.XXX Mandatory Reporting Instructions for Supervised Individuals Released from Incarceration in the Receiving State section (e). That wording reads “If the proposed residence is invalid due to existing state law or policy, the receiving state may deny reporting instructions.” This wording provides more clarity with regards to denying a mandatory request under this rule. In section (c), the rule is referencing Rule 3.106 – Request for Expedited Reporting Instructions but also includes (discretionary) in the wording. Would not support (discretionary) being included as it is not in line with current wording used in 3.106.

Dori Littler has held her current position as the Deputy Compact Administrator (DCA) for Arizona Adult Probation since December 1999. Prior to this position, She was an adult probation officer with the Gila County Probation Department in Globe, Arizona. As DCA, she is responsible for training and oversight of the interstate compact program. She was appointed as Arizona’s Compact Commissioner in January 2005, currently serves on the Rules Committee, and is a national trainer for the Training Committee. If available, the sending should be required to submit documentation or a narrative of the sex offense conviction when that is not the instant offense under transfer. This aids the receiving state with registration and supervision decisions.
For persons sentenced virtually, the SS should be required to submit the NOD at the same time the RFRI is submitted.

Chris Moore has served as Interstate Compact Administrator/Commissioner for the State of Georgia since 2012. Chris began his career in Community Supervision in 1989 as a Probation Officer. In 1998, he moved to Central Office as a Field Support Specialist and his program area was Sex Offender Supervision. In 2005 he was promoted to Center Administrator of a Day Reporting Center and in 2009 he was promoted to Chief Probation Officer. Chris received his BBA from Mercer University in 1989. He is also a Certified P.O.S.T Instructor and a Certified Alcohol and Drug Counselor.

I support the creation of a new rule that outlines the qualifications and process for requesting reporting instructions for sex offenders. Providing a dedicated rule will improve clarity and accessibility regarding the requirements, which has been a longstanding challenge in navigating these cases. Including a reference to virtual sentencings is also important. Many states use remote hearings, and recognizing this practice in the rule aligns with the 2021 ICAOS legal interpretation. It will help prevent unnecessary denials of reporting instructions in these cases.
