Establishes a new 30-day timeframe for conducting a probable cause hearing:  In Morrissey v. Brewer the court held that due process requires a prompt inquiry. While Morrissey did not establish a specific time period to conduct the hearing, it did recognize the requirement of applying timeliness to due process. This proposal sets out to address those probable cause hearings requested by the sending state that far exceed what one could reasonably consider timely. Such delays or inaction violate and infringe upon a supervised individual’s due process. The proposed language seeks to rectify such timeliness issues for transferred individuals who are subject to retaking and for whom a probable cause hearing has been requested by the sending state.

Add a statement about postponement of the hearing not just if requested by the supervised individual but also for legitimate need of the hearing officer (ie. illness of HO or PO, inclement weather etc) Also, what happens if the PC is not held within 30 days? Is the RS required to release the offender if in custody and resume supervision and remove the requirement to retake?

Alyssa Miller began her career with the North Dakota Department of Corrections and Rehabilitation in 2013 after graduating from Minot State University with a bachelor’s degree in Criminal Justice.  Alyssa has earned an array of experience as she has worked administratively as well as directly with youth and adults within the ND DOCR.

If no, explain
This is currently a "no" but only because of section (f). The established standard is that PC only needs to be established on 1 violation (see section (c)). Why are we then requiring that the hearing officer provide findings on each violation? Your justification states you are seeking to "eliminate unjustified retake" but it is the receiving state that determines what is and is not a violation in their state. The sending state should not be arguing what constitutes behavior requiring retaking in the receiving state and the receiving state already has the ability to choose to continue supervision if they deem appropriate.

While Ohio may have difficulty with the 30 day timeframe, I think it's important to add timeframes to this rule. Currently, there are times that it may be months before you have PC results which just delays the violation process.

What happens if the PCH is not completed within 30 days? is the SI released from custody? The SI may have representation that wants the hearing continued or the court/hearing officer may want it continued to provide time for evidence gathering or calling additional witnesses, etc.... If the SI has a medical condition, or the jail has a riot, and the SI can't be brought to the hearing, and it delays the hearing beyond the 30 days is the SI released?

Tracy Hudrlik is the Interstate Director for the MN Department of Corrections. In this role, she serves as the Commissioner for Interstate Compact on Adult Offender Supervision (ICAOS) and the Interstate Compact for Juvenile (ICJ) for Minnesota. I think this is a great proposal. My only question is would we need to add "and available" in regards to the language for getting PC within 30 calendar days? I am not sure if that is an issue with states- for example, a client is being held on charges and unable to post bail, would that prevent them from participating in PC until they are available? More of a question than recommendation.

Though it would not be consistent with other 30 day timeframes, WI wonders if the 30 days could be 30 business days rather than 30 calendar days to allow for concerns with scheduling/ client representation. WI also suggests adding verbiage to indicate actionable steps if the 30 day time frame is not met. As written, it is confusing what happens when the 30 day timeframe is not met. Is there no longer a requirement to retake? Should the client be released from custody?

Dori Littler has held her current position as the Deputy Compact Administrator (DCA) for Arizona Adult Probation since December 1999. Prior to this position, She was an adult probation officer with the Gila County Probation Department in Globe, Arizona. As DCA, she is responsible for training and oversight of the interstate compact program. She was appointed as Arizona’s Compact Commissioner in January 2005, currently serves on the Rules Committee, and is a national trainer for the Training Committee. Subsection (f) should be revised to be clear that a finding of probable cause does not need to be found on each allegation, only one revocable allegation.

Historically, there has been a lot of confusion regarding probable cause, and we have an opportunity to revise this rule to be consistent with the US Supreme Court cases and to be clear that probable cause only needs to be established on one revocable allegation to be valid.

Chris Moore has served as Interstate Compact Administrator/Commissioner for the State of Georgia since 2012. Chris began his career in Community Supervision in 1989 as a Probation Officer. In 1998, he moved to Central Office as a Field Support Specialist and his program area was Sex Offender Supervision. In 2005 he was promoted to Center Administrator of a Day Reporting Center and in 2009 he was promoted to Chief Probation Officer. Chris received his BBA from Mercer University in 1989. He is also a Certified P.O.S.T Instructor and a Certified Alcohol and Drug Counselor.

Fareeda Washington began her career with the Clay County Detention Center where she served as a Deputy Juvenile Officer. In 2008 she was hired by the Unified Government of Wyandotte County where she worked in the Community Corrections Department as an Intensive Supervision Officer. In 2017 she was promoted to an Intensive Supervision Supervisor. Fareeda accepted the role as Director of Interstate Compact Services for the state of Kansas in 2022.

Fareeda attended Park University in Parkville Missouri, where she obtained her bachelor's degree in Criminal Justice Administration.

KS agrees with the changes. During discussion with our state council it was pointed out that probation cases rarely have request to complete pc hearings and in KS there has not been an identified process for this to occur. If there is an influx in request for PC on probation cases the proposal is that judges would be the hearing officers for those cases however these hearings would have to be put on their docket which could be a potential problem to meet the 30 day requirement. At this time this is not a major issue.
