This rule revision provides clearer, more specific guidelines regarding the return of a supervised individual to the sending state. Under the revised rule, receiving states cannot simply send an individual back unless there is a clear violation, and the individual is unwilling to return voluntarily, they must provide adequate reason for the return. The proposal enhances procedural efficiency, reduces ambiguity in the return process, and promotes a more effective interjurisdictional management framework for supervised individuals. This proposal serves to uphold public safety while ensuring due process and compliance with existing regulations.

Alyssa Miller began her career with the North Dakota Department of Corrections and Rehabilitation in 2013 after graduating from Minot State University with a bachelor’s degree in Criminal Justice.  Alyssa has earned an array of experience as she has worked administratively as well as directly with youth and adults within the ND DOCR.

Staff reported that they would like to know the reason for the return if the SI is requesting to return to the SS. This can be helpful in case planning upon the SI's return if it is a result of issues regarding criminogenic needs or other stability factors.

Commissioner Zavaras began his career in Criminal Justice as a Community Parole Officer (CPO) for the Colorado Department of Corrections, Division of Adult Parole in 2005. As a CPO, he became knowledgeable on supervising virtually every type of caseload available from interstate cases to gangs and sex offenders. Following subsequent promotions, he became the Division's first supervisor of the Housing & Stabilization Unit, focused on hard to serve parolees experiencing homelessness and/or high mental health needs. The issue is that there is nothing that mandates that the receiving state provide an address, phone number why an individual is returning. The sending state has to take the individual back or order the individual back however it is very helpful to get info as to where they are returning and why.

Tracy Hudrlik is the Interstate Director for the MN Department of Corrections. In this role, she serves as the Commissioner for Interstate Compact on Adult Offender Supervision (ICAOS) and the Interstate Compact for Juvenile (ICJ) for Minnesota. She is responsible to provide statewide direction, planning and coordination of all activities related to the Interstate Compact for Adult Offender Supervision and Interstate Compact on Juveniles. If no, explain
NY would not support the proposed changes to this rule. While not currently allowed, NY feels that the receiving state should have the option to request return to sending state reporting instructions despite the individual having pending charges in the receiving state if the receiving state has confirmed that the individual is available for return. The inability to do so causes issues for the receiving state in instances where the individual is in the receiving state on approved reporting instructions and the transfer request has been denied and in cases where the supervised individual no longer has a valid plan in the receiving state and has requested to return to the sending state. Additionally, the current wording removes the requirement for the receiving state to provide a reason for the return and for the individual to remain in the receiving state until the reporting instructions have been approved.
Comments
The language in (d) should be reconsidered if Rule 4.105 should be passed. The notice of departure would not be required at the time of departure.

Dori Littler has held her current position as the Deputy Compact Administrator (DCA) for Arizona Adult Probation since December 1999. Prior to this position, She was an adult probation officer with the Gila County Probation Department in Globe, Arizona. As DCA, she is responsible for training and oversight of the interstate compact program. She was appointed as Arizona’s Compact Commissioner in January 2005, currently serves on the Rules Committee, and is a national trainer for the Training Committee. She has previously served as Chair of the West Region and Training Committee. In 2006, she was awarded the Executive Chair Award for her outstanding service to the Commission.

Littler regularly trains line officers, judges, attorneys and other court personnel on the rules of the interstate compact throughout Arizona. Under subsection (b) 4. it is suggested to add verbiage to account for accepted discretionary cases whereby the person's plan falls apart in the receiving state, provided the receiving state included discretionary acceptance language in the Reply to Transfer. Sending states should approve the request for return reporting instructions in these situations.
Comments
Sending states often balk at the receiving state's attempts to return the person after the discretionary plan is no longer valid or no longer exists. For example, this can happen when the discretionary plan involved attending a university and the person either quits or is kicked out prior to successful completion.

Sally Reinhardt-Stewart is the Compact Commissioner for the state of Nebraska, having been appointed in October 2020. She also serves as the Deputy Compact Administrator for Parole, having been appointed in August 2009. She has been a member of the ICAOS Training, Education, & Public Relations Committee since 2014 and is also a member of the ICAOS Compliance Committee.

 

She began her career in Nebraska Corrections in 1984, serving as an assistant to the Director for nearly 22 years. From mid-1998 to June 2006, she served as the Department’s Legislative Liaison. Although I support, another state has posed a question about sending states having 5 business days to respond on returning SOs rather than 2 business days. This would make it consistent with 5 business days that are allowed for receiving states to respond on SO requests for reporting instructions in other circumstances (Rule 3.101-3).
