This proposal provides clear criteria for what deferred sentences should qualify for compact transfers as listed in AO's 4-2004 & 6-2005.  Incorporating the criteria into the rule provides enforceable clarity and ensures consistent interpretation and application.

Commissioner Zavaras began his career in Criminal Justice as a Community Parole Officer (CPO) for the Colorado Department of Corrections, Division of Adult Parole in 2005. As a CPO, he became knowledgeable on supervising virtually every type of caseload available from interstate cases to gangs and sex offenders. NY would not support the language proposed in Rule 2.106. The proposed changes to Rule 2.106 would limit the deferred sentences that meet the criteria for mandatory transfer to only those who are residents or have resident family in the receiving state therefore eliminating the sending state’s ability to submit a mandatory transfer for an individual who received a deferred sentence and is a military transfer or employment transfer. It would also eliminate the ability of the sending state to submit a discretionary transfer to the receiving state.

This would clarify that the individual would be eligible for mandatory transfer if the individual is on supervision for a deferred sentence, has more than 90 calendar days remaining on supervision, is in substantial compliance with the conditions of supervision in the sending state and has a valid plan of supervision in the receiving state.

If no, explain
Probation and Parole has nothing to do with deferred sentences in my state. The added language reflects what a deferred disposition is in my state as the client has waived a trail, entered a plea, and it has been accepted by the Court as part of a deal. However, the client remains on bail and is not supervised during the deferred period. This piece in conflict with the new wording and that leads to confusion with thinking it is not a Compact eligible matter and yet being told at times by other states that I must transfer it.

PA supports with some conversation to consider. The concept is good, but it may be appropriate to see an analysis of how this would affect eligibility for compact services for each state’s deferred sentences. We are cautious with the limited wording of “entered plea of guilt or no contest” as there are legal distinctions associated with different kinds of pleas. For example, we must consider an Alford plea. This plea can be defined several ways but in general, the defendant concedes that the prosecution has enough evidence to convict, but the defendant still refuses to admit guilt. Do we consider this type of plea in the same general regard as outlined in the proposal?

Ms. Gilmore graduated Southeast Missouri State University in 1990 with a B.S. in Criminal Justice and minor in Psychology. In 2009, she moved to Virginia where she became employed with the Virginia Department of Corrections as a Probation Parole Officer from 2010 through 2015 and held the positions of an ICOTS Officer and a Gang Specialist/Intensive Supervision Officer. During her time with VA DOC, she was a T4C facilitator, completed EPICS, MI and Dialogue training. She is also a graduate from the VA Corridors Program. Ms. Gilmore moved to Walla Walla, Washington in October 2015 where she held the position of CCO2. She accepted the promotion for WA DCA in May, 2016.

Fareeda Washington began her career with the Clay County Detention Center where she served as a Deputy Juvenile Officer. In 2008 she was hired by the Unified Government of Wyandotte County where she worked in the Community Corrections Department as an Intensive Supervision Officer. In 2017 she was promoted to an Intensive Supervision Supervisor. Fareeda accepted the role as Director of Interstate Compact Services for the state of Kansas in 2022.

Fareeda attended Park University in Parkville Missouri, where she obtained her bachelor's degree in Criminal Justice Administration.
