Clearly defining violations of this rule and granting receiving states discretion to allow individuals to remain during investigations can help prevent unnecessary returns. States often reject cases by citing this rule without considering how the supervised individual entered the receiving state, especially when virtual sentencing may not involve actual relocation. Requiring prompt notice, coordination, investigation, and communication can improve outcomes, reduce unnecessary returns, and enhance victim safety in the sending state.

If no, explain
By including the term "relocated" in the new language in b1 and b2, you have made it so that a supervised individual would need to be out of state for more than 45 calendar days without proper approval for this rule to apply. Not sure that was the intention or not. Also, in b1, "shall provide notice" to WHOM?

I understand this rule has existed for some time with similar language but in looking at it for this rule proposal it dawned on me that I am not sure how the Commission can make a non-interstate compact fugitive who never signed an application for transfer and never requested transfer, fall under Compact rules.

Potentially it should be limited to those who signed an application for transfer or have an ICOTS profile pending/active? Having a fugitive who never requested transfer or maybe even reported for supervision seems like it should not fall under the Compact but rather under normal fugitive processes.

Clarify whether this applies to homeless or unhoused population in the Sending State.
Comments
Previously we have seen Expedited RFRIs submitted when a S/I is attempting to avoid homelessness in the sending state. Some states see avoiding homelessness as a situation where they would approve the RIs, some do not. Under this proposed rule language, we foresee the possibility that some states will use this rule to justify allowing an S/I to leave the sending state without approved RIs and then ask the receiving state to consider agreeing under 2.110(b)(2). If this is something that is supported by the Compact, it should be explicitly stated in the language of the rule.

Commissioner Zavaras began his career in Criminal Justice as a Community Parole Officer (CPO) for the Colorado Department of Corrections, Division of Adult Parole in 2005. As a CPO, he became knowledgeable on supervising virtually every type of caseload available from interstate cases to gangs and sex offenders. Regarding subsection (b)(1) – Clarify how the Sending State or Receiving State shall provide immediate notice, and to whom?

Regarding subsection (b)(2) - Could leave the Receiving State open to always disagreeing based on a Sending State error, and having a SI report back to the Sending State regardless of the reason for relocation. It may not accomplish in the end what the proposed rule is trying to accomplish.

I support the intent of the rule. I agree with a comment above the the word relocate in the new definition might need to be changed to a different word like departed. If I find a client in my state that came there from another state without permission and I notify them and we cannot agree to reporting instructions am I assuming that this request was done in ICOTS or just over the phone for documentation purposes.

If a client of mine has moved to another state without permission and I have not had, nor intended to, submit an ICOTS case (Essentially the client has absconded from my supervision) if a receiving state finds them there, am I now mandated to get a nationwide warrant for a case that I had no intention of transferring? If I do not attempt to get them to stay there, does that remove this obligation?

Prior to his current appointment, he worked in the field of victim services for over 13 years as a victim advocate both at the county and state level. Mr. Reed also volunteered for many years as a crisis responder for several organizations and was a volunteer mediator for the Commonwealth’s Victim/Offender Mediation Program. In 2008, Mr. Reed assumed the position of Parole Manager within Interstate Services overseeing the incoming unit. In 2013, he graduated from the Governor’s Emerging Leader Program. Mr. Reed previously served as a national trainer for the ICAOS Training Committee.

Ms. Gilmore graduated Southeast Missouri State University in 1990 with a B.S. in Criminal Justice and minor in Psychology. Upon graduation she became employed in her native Missouri Bootheel with the Missouri Department of Corrections as a Probation & Parole Officer before transitioning into the substance abuse field where she was a counselor and program facility manager. During her time with VA DOC, she was a T4C facilitator, completed EPICS, MI and Dialogue training. She is also a graduate from the VA Corridors Program. I support the intent of the rule, but it's always been confusing as to what point is the SI considered a compact individual and the state should be responsible for a nationwide warrant; is it if they signed an application, is it if the SI asked to be transferred, or is it based solely on the fact the SI meets compact eligible criteria, and they've absconded.

Sally Reinhardt-Stewart is the Compact Commissioner for the state of Nebraska, having been appointed in October 2020. She also serves as the Deputy Compact Administrator for Parole, having been appointed in August 2009. She has been a member of the ICAOS Training, Education, & Public Relations Committee since 2014 and is also a member of the ICAOS Compliance Committee.

 

She began her career in Nebraska Corrections in 1984, serving as an assistant to the Director for nearly 22 years. From mid-1998 to June 2006, she served as the Department’s Legislative Liaison. She accepted a position with the Washington Department of Corrections as Special Assistant to the Secretary and was with that Agency from June 2006 until March 2008, serving as the Agency’s Legislative Liaison and as Constituent Services contact with the Legislature. She returned to Nebraska Corrections in May 2008 and in October of that year joined the Parole Compact Office at the time the new Interstate Compact Offender Tracking System (ICOTS) was implemented. In July 2016, Parole was placed under the authority of the Nebraska Board of Parole as a result of legislation that passed in 2015.

 

Ms. Reinhardt-Stewart is a member of the American Correctional Association (ACA) and was a recipient of an Excellence in Leadership Award for the state of Nebraska in 2018. Sally is a graduate of Kansas City Business College.

I believe the purpose of the rule change is to address those individuals who meet the criteria to transfer and are eligible but for whatever reason are located in the receiving state prior to a transfer being accepted and/or maybe an application being signed. I like that this allows the two states to assess the situation and give the receiving state that authority to allow Reporting Instruction upon discovery.
